1. General Agreement

By booking with JiVViStudio, the client (“Client”) acknowledges and agrees to all terms stated herein. These Terms & Conditions are legally binding and non-negotiable. JiVViStudio reserves the right to update or amend these Terms at any time. All active bookings will adhere to the version in effect at the time of booking.

2. Payment Policy

  • All payments, retainers, and balances are non-refundable and non-transferable under any circumstance, including cancellations, rescheduling, or changes in personal circumstances.

  • A non-refundable retainer is required to secure the date and time. The remaining balance must be paid in full prior to the session or event date.

  • Chargebacks or payment disputes are strictly prohibited. Any attempt to reverse or dispute a valid payment after services have been rendered will be considered fraudulent and subject to collection and legal action.

3. No Refunds or Exchanges

Due to the nature of photography and creative services, all sales are final. This includes session fees, editing services, digital images, wall art, albums, prints, and any additional upgrades.
JiVViStudio invests significant time, labor, and resources into each project—therefore, no refunds or exchanges will be issued once work has begun or services have been reserved.

4. Client Responsibility

  • Clients are responsible for verifying all information prior to booking, including session type, date, contact details, and package selections.

  • JiVViStudio is not liable for errors or delays resulting from incomplete or incorrect client submissions.

  • Once a booking form, quote, or invoice is signed and/or paid, the format, package, and terms cannot be modified or altered by the client.

5. Image Delivery & File Handling

  • All final files are delivered through secure online systems. The provided gallery format and delivery method are final and cannot be changed or requested in alternative formats.

  • Clients are encouraged to download and back up their images immediately upon receipt. JiVViStudio is not responsible for lost, deleted, or expired download links.

  • RAW files, unedited images, and behind-the-scenes materials remain the sole property of JiVViStudio and will not be released under any circumstance.

6. Copyright & Usage Rights

  • All images, videos, and creative content remain the exclusive intellectual property of JiVViStudio under U.S. Copyright Law (Title 17).

  • Unauthorized reproduction, alteration, resale, or distribution is strictly prohibited.

  • Clients receive a limited, non-exclusive, personal-use license for purchased digital images. Commercial, promotional, or editorial use requires a separate written licensing agreement.

7. Editing & Artistic Rights

  • JiVViStudio retains full creative discretion over image selection, curation, retouching, and final presentation.

  • Clients agree to trust JiVViStudio’s artistic direction and editing style.

  • Third-party re-editing, color alterations, or use of filters on JiVViStudio’s work is not permitted and voids all quality guarantees.

8. Privacy & Model Release

Unless otherwise specified in writing, JiVViStudio reserves the right to use images and video content for portfolio display, website galleries, social media, studio samples, advertising, or educational purposes.
Clients who wish to keep their session fully private must request a Full Privacy Release option in advance (additional fees may apply).

9. Limitation of Liability

  • JiVViStudio will take every reasonable precaution to ensure professional results. However, in the rare event of unforeseen circumstances (equipment failure, illness, accident, or force majeure), JiVViStudio’s liability shall be limited to rescheduling or a studio credit — not a refund.

  • JiVViStudio is not responsible for indirect, incidental, or consequential damages resulting from any project or transaction.

10. Delivery Timelines

Delivery timelines are estimates and may vary based on volume, production schedule, or external conditions. JiVViStudio strives to deliver all final images promptly but does not guarantee exact turnaround dates unless otherwise agreed in writing.

11. Agreement Enforcement

By signing electronically, submitting payment, or confirming a booking through JiVViStudio, the Client acknowledges and accepts all Terms & Conditions listed above.
This agreement supersedes any prior verbal or written communications.

Legal Notice

Any disputes arising from this agreement shall be governed by the laws of the State of New York & California. Unauthorized chargebacks, cancellations, or misuse of intellectual property will result in immediate legal and financial action.
